Claim Filing Procedures
All claims must be made in writing to ByExpress Transportation.
The following documents must be attached to the claim:
Original bill of lading if not surrendered to carrier
Original PAID Freight expense bill
Original invoice or photocopy
Other particulars obtained in proof of loss or damage claimed
Suppliers invoice showing value of shipment
Final proof of delivery
Damages and shortages must be noted on carrier's proof of delivery when delivery is made. The following are not acceptable notations on proof of delivery and will not allow for claim:
Subject to inspection
Possible shortages
Possible damages
Damages which are not visible at the time of delivery must be reported immediately to the carrier, without delay. When concealed damages are found, stop unpacking, note damage, notify carrier and request inspection. If the shipment is unpacked after damage is found, a claim cannot be submitted. Please keep all packaging for inspection.
All claims must be submitted within 30 days of delivery.
Liability is $2.00/lb when there is no declared value on the bill of lading at shipping.
When there is a declared value, liability will be for the value declared, only with supporting invoices and bills to confirm value.
Shipments must be inspected by the carrier’s bill and not the packing slip.
We are not liable for shipments shipped at owner’s risk of damages, or shipments that are unpacked, opened or uncrated/unskidded. File this type of claim with supplier.
All damaged goods must be held by customer until claim is settled. All damaged goods shall then be turned over to carrier for salvage.
